If you are moving to the UK on a Skilled Worker Visa, this doesn't have to mean you have to leave your family behind. You are allowed to bring along your family members as dependants under the immigration system in the UK, so that you may be together while you are in the country. A UK Dependent Visa is available to the partner and children of a skilled worker who meets all the eligibility requirements. 

Who Can Apply for a Dependent Visa UK?

A dependant is any of the following:

  • Your spouse, civil partner, or unmarried partner: That is a relationship which either is legally recognised in the UK through marriage or civil partnership for married or civil partners or must have been in existence for at least two years continuously for unmarried partners.
  • Your child below the age of 18: If your child is born in the UK during your stay, then they will be obligated to apply for a dependant visa.
  • Your child over the age of 18: A child who was initially in the UK as a dependant may apply to extend his or her period under a dependant visa.

This category is usually limited to spouses/partners and children of a migrant on a Skilled Worker Visa. It is very important to note that, depending on the category of senior care workers or any other category of care worker, different restrictions may apply, especially in particular cases where the visa is issued after March 2024.

 

Criteria for Dependents Visa UK Eligibility

To be defined as a dependant, the following criteria shall be true:

  • Relationship Evidence: You have to show that you are married or in a long-term relationship if applying as a spouse or partner for a dependant visa. Unmarried partners must demonstrate they have been cohabiting for at least two years.
  • Children's eligibility: If your child is under the age of 18, they must be living with you unless they are away studying at boarding school or university. They should not be married or in a civil partnership.
  • Financial requirements: You will need to show that you can provide for your family financially. This requires showing at least £285 available for your partner, £315 for your first child, and £200 each for additional children. You must have owned these funds continuously for at least 28 days before the application.

 

Supporting Documents You Will Need

Depending on your application, some documents will be required for eligibility; these may include, but are not limited to:

1. Proof of relationship: This will vary, but it could be a marriage certificate in cases of spouses, civil partners, or unmarried partners, or proof that you have lived together continuously for at least two years, such as through joint tenancy agreements or utility bills in both your names.

2. Proof of finance: Bank statements, pay slips, or a letter from your employer confirming that they will be paying for your family's first month in the UK.

3. Proof of identity: Your dependants will need to provide their passport and biometric information; this consists of fingerprints and photographs. They can either do this at a visa application centre or using the 'UK Immigration: ID Check' app, depending on which option is available in their country.

4. Proof of address: In case there are children above 18 years of age, or studying away from home, you will need to show proof of their most recent address via official letters from their university or college, bank statements, or such other documents.

 

 Application Process for Depend Visa UK Outside the UK Application

For families applying outside the UK, this involves:

1. Apply online: All dependants must apply online separately. Applications should be made before the dependant's travel to the UK and they will need your application number (GWF or UAN) which you will have been provided with when you made your application for a Skilled Worker Visa.

2. Biometric enrolment: Unless your partner and children can use the 'UK Immigration: ID Check' app, they will have to attend a visa application centre to give their fingerprints and a photo.

3. Decision time: Once the application has been made, a decision usually takes about three weeks, although there is the option to pay for an expedited process.

 

Financial Requirements

In your application for a UK Dependent Visa, you will have to be satisfied that you can be maintained without recourse to public funds and provide for yourself and any dependents. The financial requirement for the dependant is as follows:

  • £285 for your partner
  • £315 for one child
  • £200 for each additional child

These need to have been held in one or more of your bank accounts for a consecutive period of at least 28 days. The 28-day period must be within the 31 days preceding the date of application. Alternatively, your employer may be willing to sponsor your family's living costs in the UK for the first month. They must confirm this on your certificate of sponsorship, which will exempt you from having to show money yourself.

 

Duration of Dependant Visa UK

The same provisions will apply to any dependants of yours; their visas will mirror the validity period of your visa. For example, if your Highly Skilled Worker Visa is valid for five years, the visas for your dependants will also be issued for five years. In circumstances where the parents have different expiry dates on their visas, the child's visa will be made to expire on the earliest date.

 

What Can You Do with the UK Dependant Visa?

If your partner and children are successful in getting their dependant visa for the UK, they then have the following rights and restrictions during their stay:

  • They can work, except as a professional sportsperson or coach.
  • They can study without restriction.
  • They can travel abroad and return to the UK.
  • They can apply for indefinite leave to remain after living in the UK for 5 years, provided they meet other eligibility criteria.
  • They, however, do not get access to public funds and are not able to claim benefits.
